2. Acceptance of Terms
By accessing or using our website, application process, customer portal, or support services, you agree to these Terms and to our Privacy Policy and Cookie Policy.
When you submit a loan application, you may also be required to accept the quoted loan agreement, credit check consent, debit order authorization, and other regulated disclosures captured in the application flow.
3. Eligibility and Account Responsibility
You may only use our lending services if you are legally permitted to enter into a binding agreement and meet our eligibility criteria, including affordability and identity checks required by applicable law.
You are responsible for ensuring that information you submit is accurate, complete, and current. You are also responsible for protecting your login credentials and for activity performed through your account.
4. Nature of Services
Prospera provides short-term credit products subject to application review, creditworthiness, affordability assessments, verification, and compliance controls.
Submitting an application does not guarantee approval. We may decline or limit applications where risk, compliance, or operational requirements are not met.
5. Pricing, Fees, and Loan Terms
Loan pricing, fees, and repayment details are provided before acceptance in the relevant quotation, pre-agreement statement, and final agreement.
You must review all disclosures before accepting a loan. By accepting, you confirm that you understand the total cost of credit, repayment schedule, and any consequences of late or missed payments.
Where a debit order is authorized, you also authorize automated repayment collections in accordance with the schedule disclosed for the loan.
6. Prohibited Use
You agree not to misuse the platform. This includes:
- Providing false, misleading, or fraudulent information.
- Attempting unauthorized access to systems, accounts, or data.
- Using bots, scraping, reverse engineering, or similar automated extraction tools.
- Uploading malicious code or attempting to disrupt service availability.
7. Electronic Communications and Records
You consent to receiving notices, disclosures, and service communications electronically, including by email, SMS, and in-app or portal messaging, where legally permitted.
You are responsible for maintaining valid contact details and checking your communications regularly. We maintain electronic audit records of material borrower agreements, notices, and signatures.
8. Intellectual Property
All platform content, branding, software, and related materials are owned by or licensed to Prospera and are protected by applicable intellectual property laws.
You may not copy, reproduce, distribute, or create derivative works without prior written permission.
9. Service Availability and Changes
We aim to keep services available and secure, but uninterrupted availability cannot be guaranteed. Maintenance, security events, third-party outages, and force majeure may affect uptime.
We may update, suspend, or discontinue features when necessary for legal, risk, security, or operational reasons.
10. Liability and Disclaimer
Services are provided on an "as available" basis. To the maximum extent permitted by law, Prospera excludes implied warranties and is not liable for indirect, incidental, special, consequential, or punitive damages.
Nothing in these Terms excludes liability that cannot be excluded under applicable law.
11. Complaints and Dispute Resolution
If you have a complaint, submit it using the procedure in our Complaints page. We will investigate and respond within our published service timelines.
If unresolved, you may escalate through applicable statutory or industry channels available in South Africa.
12. Governing Law, Retention, and Updates
These Terms are governed by the laws of South Africa. Any disputes will be handled in accordance with applicable South African law and competent jurisdiction.
Borrower data is retained in line with applicable legal obligations and our Privacy Policy. Where lawful retention duties permit, inactive borrower data is scheduled for automatic deletion after 5 years of no activity.
We may update these Terms from time to time. Material updates will be posted with a revised "Last updated" date.
